Terms of Service

These Terms of Service ("Terms") govern your use of Brightnight (the "app"), operated by Diserve Ventures Oy ("we", "us"). By creating an account, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old to use Brightnight. We set this threshold higher than a typical social app because Brightnight involves real-time location sharing, arranging in-person meetups with strangers, and venue content that references alcohol-adjacent settings (bars, restaurants) even though the app itself is alcohol-free-focused — all of which warrant an adult-only audience. By creating an account, you confirm you meet this age requirement.

2. Your account

• You're responsible for keeping your login credentials secure and for all activity under your account.
• You must provide accurate information — impersonation or fake profiles are not allowed.
• One person, one account.

3. Acceptable use — zero tolerance for objectionable content or abusive users

Brightnight exists to help sober, sober-curious, and exploring people connect without judgment. We have zero tolerance for objectionable content and abusive behavior on Brightnight. To keep it that way:

• Be respectful, not judgmental. Don't question, minimize, or interrogate anyone's reasons for being here, whatever their relationship with alcohol is.
• No promotion of alcohol or illegal substances. Content promoting drinking, encouraging others to drink, or promoting illegal substances is not allowed — this app is specifically alcohol-free-focused.
• Be real. Moments should reflect where you actually are and what you're actually doing — don't post on someone else's behalf or misrepresent your location.
• No harassment, hate speech, or threats of any kind. Zero tolerance — accounts responsible for this are removed, not warned.
• Respect others' privacy. Don't share screenshots, photos, or personal details of other users without their consent.
• No spam or unrelated self-promotion.
• No illegal activity conducted through or facilitated by the app.
• No sexual, violent, or otherwise objectionable content of any kind.

This list isn't exhaustive — use good judgment. Our in-app Community Guidelines screen covers this in more detail and may be updated from time to time.

4. Content ownership and license

You own the content you post (photos, captions, profile info). By posting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and display that content within the app as necessary to operate the service (e.g. showing your Moment to your connections). This license ends when you delete the content or your account, except for copies already shared with others through normal use of the app before deletion (e.g. someone who already viewed and remembers a public Moment).

5. Content moderation and reporting

• Users can report Moments, profiles, or events they believe violate these Terms or our Community Guidelines, using the in-app Report feature.
• Users can block other accounts at any time, which immediately hides that account's content from their feed and prevents further contact. Blocking also notifies us so we can review the blocked account.
• We review and act on every report within 24 hours. Where a report is upheld, we remove the offending content and, for serious or repeated violations (harassment, hate speech, threats, sexual or violent content), permanently remove the responsible account.

6. Account suspension and termination

We may suspend or terminate your account, with or without notice, if we believe in good faith that you've violated these Terms, engaged in behavior harmful to other users, or misused the app. You may delete your own account at any time from Profile → Settings in the app.

7. Venue and location information

Venue details (name, address, rating, type) are sourced in part from Google's Places data and in part from tags applied by our community. We don't guarantee this information is accurate, complete, or up to date, and listing a venue is not an endorsement or a guarantee that it is alcohol-free or "sober-friendly" in any particular way — always use your own judgment. Drink product information and photos come in part from Open Food Facts contributors, under the Open Database License (ODbL) and CC BY-SA; we don't guarantee their accuracy either.

8. Disclaimer of warranties

Brightnight is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee the app will be uninterrupted, error-free, or secure, and we don't vet the identity, intentions, or background of other users. You are responsible for your own safety when meeting people from the app in person — meet in public places, tell someone where you're going, and use common sense.

9. Limitation of liability

To the fullest extent permitted by law, Diserve Ventures Oy is not liable for any indirect, incidental, or consequential damages arising from your use of the app, including but not limited to interactions with other users, venue information, or content posted by others.

10. Governing law

These Terms are governed by the laws of Finland, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of Espoo, Finland, except where mandatory consumer-protection law gives you the right to bring a claim in your own country of residence within the EU.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you in the app before they take effect. Continuing to use Brightnight after that means you accept the updated Terms.
